Critical Illness Insurance Policy Claim

Mrs P worked as a care assistant in a nursing home. Following a fall she developed Complex Regional Pain Syndrome which prevented her from returning to work. She was ultimately dismissed by her employer on ill health grounds.
Mrs P had a critical illness insurance policy which entitled her to a lump sum of £100,000 if she became permanently unable to work in her own occupation as a care assistant. She submitted a claim but it was rejected following an assessment by the insurance company’s doctor.
BLB Solicitors reviewed the claim and wrote to the insurance company stating that they should be paying out. However, they still refused to do so.
A medical expert was instructed and following disclosure of the report to the insurance company they agreed to pay the claim in full. This shows the importance of challenging medical opinions and that insurers sometimes accept a second opinion with little if any complaint.
